Yesterday, U.S. District Judge Audrey B. Collins denied the Santa Monica Nativity Scenes Committee's Motion for a Preliminary Injunction. It means that for the first time in 60 years, the Nativity scenes will not be exhibited in Palisades Park. The court's ruling, however, doesn't end the matter.
On December 3, the court will hear the City of Santa Monica's Motion to Dismiss the lawsuit. Based on the court's reasoning in the motion already heard, we are not optimistic the court will side with us. Should the City prevail, the case will be dismissed, and the Committee will need to decide whether it wishes to appeal the ruling.
This case has drawn media attention from all over the world, making it to the top of the Drudge Report, then to its first column, the New York Times, LA Times and countless radio and TV stations. The silver lining is that--through the media--word has gotten out to the world that Santa Moncia is no longer the City of the Christmas Story, a nickname it has held for decades. Now, Santa Monica is the City that Opposes Free Speech and Religious Liberty.
